आप अपने case के लिए फीस देते हैं, documents सौंपते हैं और उम्मीद करते हैं कि आपका Advocate कानून के सही provisions और genuine judgments पर भरोसा करेगा। लेकिन अगर किसी legal draft में ऐसा judgment cite हो जो असल में मौजूद ही नहीं है, तो नुकसान केवल एक typing mistake तक सीमित नहीं रह सकता। Delhi-NCR में legal support लेते समय यह समझना जरूरी है कि research का दिखना और कानून का सही होना दो अलग बातें हैं।

Focus: Supreme Court ने AI-generated Fake Judgments पर क्या कहा?

2 July 2026 को Supreme Court ने Pooja Ramesh Singh v. Jammu and Kashmir Bank Ltd., 2026 INSC 668 में ऐसे non-existent judgments और fabricated paragraphs पर विचार किया, जिन्हें NCLT ने अपने decision में precedents की तरह इस्तेमाल किया था। Supreme Court ने पाया कि कुछ citations गलत थीं, कुछ वास्तविक cases के नाम पर non-existent paragraphs दिए गए थे, और कुछ citations ही मौजूद नहीं थीं।

Court ने NCLT और NCLAT के impugned decisions set aside किए और matter को NCLT में वापस भेजा। उसने साफ कहा कि AI-generated judgments को verify किए बिना cite करना advocate की misconduct है। ध्यान रहे: इस case में fabricated precedents NCLT के decision में इस्तेमाल हुए थे; Court ने यह नहीं कहा कि वे opposing counsel द्वारा cite किए गए थे।

Emotion: आपका भरोसा किस आधार पर टिका है?

मान लीजिए, आपके पास कोई महत्वपूर्ण civil dispute, business litigation, employment issue या police complaint से जुड़ा legal matter है। आपका legal strategy किसी judgment पर आधारित है। बाद में पता चले कि उस judgment का relevant paragraph मौजूद ही नहीं है।

तब सवाल उठता है: क्या आपका argument सही कानून पर आधारित था? क्या आपकी अगली filing में correction की जरूरत है? क्या आपने जिस advice पर भरोसा किया, उसे independently verify किया गया था?

ऐसी स्थिति में समय, पैसा, professional reputation और family peace पर दबाव बढ़ सकता है। इसलिए legal research को सिर्फ impressive language, लंबी citations या AI-generated drafting से judge मत कीजिए।

Agitation: Fake Citation का पता Court में चले तो?

Supreme Court ने बताया कि fake या hallucinated precedents judicial decision-making की integrity को प्रभावित कर सकते हैं। उस मामले में दोनों impugned decisions set aside हुए और proceedings फिर से NCLT में बहाल की गईं। लेकिन इसका अर्थ यह नहीं है कि हर गलत citation से हर case अपने-आप खत्म हो जाता है या हर बार वही remedy मिलेगी।

अगर आपको अपने matter में suspicious citation दिखाई देती है, तो:

Case name, court, date और neutral citation या law-report reference verify करें।
Judgment का पूरा text authoritative source से प्राप्त करें।
जिस paragraph पर आपका argument आधारित है, उसे मूल judgment से मिलाएं।
अपने Advocate से written clarification और corrected draft मांगें, जहाँ आवश्यक हो।
अगर Court में कोई गलत material पहले ही file हो चुका है, तो जल्द independent legal review लें; उसे छिपाने या बिना सलाह के नया कदम उठाने से बचें।

सबसे खतरनाक स्थिति वह है जिसमें आपको पता ही न हो कि आपके case की legal foundation सही है या नहीं। समय रहते verification करने से आप उपलब्ध correction या lawful remedy पर विचार कर सकते हैं।

Repetition: AI इस्तेमाल हो, लेकिन Verification अनिवार्य हो

AI research में सहायता कर सकता है; वह legal responsibility का substitute नहीं है। Genuine case law, सही statutory provisions और आपके facts से उनका संबंध—इन सबका verification जरूरी है।

Case-specific caution: Pooja Ramesh Singh में Supreme Court ने fake or hallucinated precedents पर आधारित NCLT और NCLAT decisions set aside करके matter remand किया; उसने underlying insolvency dispute के merits पर कोई final opinion नहीं दिया। यह निर्णय legitimate AI use पर blanket ban नहीं है। आपके matter में correction, appeal या अन्य remedy उपलब्ध है या नहीं, यह actual record, procedural stage और limitation पर निर्भर करेगा।
