क्या दोनों cases साथ-साथ चलेंगे?
क्या Indian Court को foreign case की जानकारी देनी जरूरी है?
और अगर किसी party ने foreign Court का important order Indian Court से छिपा दिया तो?
Delhi High Court ने 10 June 2026 को एक ऐसे ही cross-border matrimonial dispute पर important observations दिए.
Case था Somya Goel v. State (NCT of Delhi) & Anr.
Record में सामने आया कि husband ने Singapore में divorce proceeding पहले ही institute कर दी थी.
Foreign Court में pleadings और contested applications भी आगे बढ़ चुके थे.
लेकिन बाद की Indian proceedings में उस foreign litigation और उसके important orders के disclosure को लेकर serious issue सामने आया.
Court ने यह भी ध्यान में रखा कि foreign Court ने पहले ही कुछ issues पर orders pass किए थे और Indian Court proceedings के दौरान उन proceedings को disclose करने का सवाल महत्वपूर्ण था.
NRI Husband को यह बात क्यों समझनी चाहिए?
Cross-border matrimonial dispute में सिर्फ यह कहना कि
“मैं तो foreign country में रहता हूँ, India में जो होगा देख लेंगे”
बहुत risky approach हो सकती है.
Foreign divorce case.
India में matrimonial complaint.
Child-related proceedings.
Property dispute.
Anti-suit proceedings.
इन सबकी timelines अलग हो सकती हैं.
और सबसे important —
एक Court के सामने दूसरे Court में चल रही proceeding या order को छिपाना बाद में credibility और litigation strategy दोनों को प्रभावित कर सकता है.
इसलिए अगर आपका marriage dispute India और foreign country दोनों से जुड़ गया है, तो सबसे पहले एक complete litigation map बनाइए:
कौन-सा case कहाँ pending है?
कब file हुआ?
किस Court ने पहले order दिया?
कौन-से pleadings और affidavits filed हैं?
क्या कोई interim order है?
क्या दूसरे country में कोई proceeding disclose करनी बाकी है?
