CAW CELL DELHI | MenCell.
A matrimonial dispute can become so bitter that eventually husband-wife litigation starts affecting the child’s school life.
The Delhi High Court recently dealt with a closely connected situation in Vimlendu Kumar Jha v. Minal Bhatnagar, CM(M) 2800/2024, decided on 2 April 2026.
The parties were already involved in divorce proceedings before the Saket Family Court. Their young daughter was living with the mother. The father sought wider visitation as well as involvement in decisions concerning the child's education, including contact with the school, updates and participation in school activities.
Initially, the Family Court had permitted the father to attend the child’s school PTMs and allowed him to provide his phone number and email address to the school so that he could receive updates about the child’s progress.
By the time the matter reached its later stage before the High Court, the Court recorded that the father had been given access through the school’s parent-teacher association, the school’s e-portal reflected him as the child’s father, and he had also been provided a school gate pass.
A father may not have physical custody of his child, but that does not automatically mean that he should become a stranger to the child’s education and social development.
The Court observed that a father has rights relating to effective visitation and participation in the child's social and educational progress, while repeatedly keeping the welfare of the child as the paramount consideration.
The dispute also shows why parents should avoid turning every school interaction into another battlefield.
In this case, the Court did not simply hand over unrestricted custody. Instead, considering the child’s age and circumstances, it directed the parents and child to undergo sessions with a child counsellor/psychologist attached to the Delhi High Court Mediation and Conciliation Centre, with a report to be placed before the Family Court before the issue of unsupervised visitation was finally reconsidered.
So, if a Delhi matrimonial complaint, CAW Cell proceeding, divorce case or family dispute is already running, a father should think beyond the immediate criminal allegations.
School records, PTM participation, parent-portal access, educational communication and the child's day-to-day academic progress can become important practical issues.
This is particularly relevant where a husband is facing CAW Cell Delhi / Crime (Women) Cell proceedings, matrimonial litigation, DV proceedings or related Family Court disputes and simultaneously wants to remain a responsible and documented part of his child's education.
The lesson is not simply “fight for custody”.
Sometimes the immediate and more practical question is:
क्या father को बच्चे की पढ़ाई की information मिल रही है? क्या school उसे PTM में शामिल कर रहा है? क्या उसका email/phone school records में है? क्या educational communication दोनों parents तक पहुँच रही है?
These details should not be ignored until the family dispute becomes much harder to manage.

Case-specific caution: The Delhi High Court’s directions in Vimlendu Kumar Jha v. Minal Bhatnagar arose from the particular facts, age of the child, existing visitation arrangements and the material before that Court. The judgment does not mean that every father in matrimonial litigation will automatically receive identical school access, visitation or educational decision-making rights. Each case depends on its own facts and the welfare of the particular child.
